State law A.C.A. 21-5-213 allows for additional compensation of employees working late shifts

Q. Who is eligible for additional compensation?

A. An employee is eligible if:

• The agency or institution or any sections thereof routinely schedules more than one (1) work shift per day.
• The employee is regularly assigned to the late shift or is assigned to the shift on a regularly scheduled rotating basis.
• The shift to which the employee is assigned is a full work shift beginning not earlier than 2:30 p.m. and ending not later than 8 a.m. the next day.

Q. I work from 1:00 p.m. to 9:00 p.m.  Am I eligible for additional compensation?

A. No. To be eligible, the shift to which the employee is assigned must be a full work shift beginning not earlier than 2:30 p.m. and ending not later than 8:00 a.m. the next day.

Q. How much is a late shift employee eligible for?

A. The employee may be compensated at an additional rate not to exceed five and one half percent (5.5%) of their eligible salary under the provisions of this subchapter.
