Course Reserve Guidelines
1) Torreyson Library provides Reserve services in both hardcopy Reserve and e-Reserve. Hardcopy Reserves are held at the Library Circulation Desk, and e-Reserves are accessible via the Library's website.
2) Photocopied materials:
a) Torreyson Library adheres to the UCA General Counsel guidelines for Copyright Compliance, and these guidelines may be viewed at Copyright Compliance. Unless the Faculty member requests otherwise, approved materials will be placed on both hardcopy Reserve and e-Reserve.
b) Permission from the copyright holder is required if photocopied material is to be re-used in a subsequent academic term for the same course offered by the same instructor, does not meet “fair use” guidelines, or if the material is a reading for a course taught in multiple sections by many instructors.
c) Materials may be retained in electronic form while permission is being sought or until the next academic term in which the material might be used, but in no event for more than three calendar years, including the year in which the materials are last used.
3) Personal copies: Personal copies of books, videos, music recordings, and journals loaned for reserve will be available on reserve for two hour use within the Library and may be claimed at the end of the semester. Please note that personal copies may be damaged due to use throughout the semester, and Torreyson Library is not liable for such damage.
4) Materials from other institutions: Only materials from Torreyson Library or owned by a faculty member or another UCA entity may be placed on reserve. Books, journals and articles procured through Interlibrary Loan from other institutions cannot be placed on reserve even if fees have been paid by the individual.
5) Materials that are available in one of the Library's e-collections (i.e. databases) may not be placed on hardcopy Reserve. As an alternative, please direct students to the persistent web link for the item.
6) Number of copies of one item: Due to space constraints, one copy will generally be placed on hardcopy Reserve.
7) Only original, non-commercially produced items (i.e. a faculty member’s course notes) or items in the public domain, may be placed on Reserve without permission from the owner of the copyright.
8) Other items not available for placing on reserve - required class textbooks or copyrighted consumables (such as workbooks, standardized tests and answer sheets)
9) Placing student work examples on reserve - Any use of that work must be with the express and written permission of the student. According to United States copyright law, the creator of any copyrightable work owns all rights to that work unless they are bona fide employees or have entered into a valid, written and signed agreement transferring those rights to a third party.
"Fair Use" Guidelines

Materials not protected by copyright guidelines and which may, therefore, be freely used include:

Works that lack originality

Logical, comprehensive compilations (telephone book)

Unoriginal reproductions of public domain works (including photographs)

2) Fair use permits certain uses for certain purposes, but is not a blanket exemption for educators. Four factors must be examined:

The purpose and character of the use, including whether such use is of a commercial nature or is of a nonprofit educational purpose (education use over commercial use)

The nature of the copyrighted work (published or fact based, over original or unpublished)

The amount and substantiality of the portion used in relation to the copyrighted work as a whole (small amount over more than small amount)

The effect of the use upon the potential market for, or value of, the copyrighted work (i.e. a short excerpt may not be fair use if it is a substantial portion or the central significance of a commercially valuable work).
Reserve Shelf Time Limits for Photocopied Materials on Hardcopy Reserve

This does not mean that the material is available for students – it is retained in electronic form for storage only.
Procedure for Placing Materials on Reserve
1) Faculty member fills out and submits the form at the bottom of the page.
2) Request forms are given to the Copyright Compliance Librarian for review.
3) If the material meets the "Fair Use" guidelines, the Copyright Compliance Librarian approves the Copyright Compliance Checklist, returns it to the Circulation Desk for processing, and the material is placed on Reserve.
4) If the material does not meet the copyright guidelines, the Faculty member will be notified by e-mail or telephone. The material will be returned to the Faculty member, and the Faculty member may seek to obtain copyright permission from the copyright holder in one of two ways:
a) Permission may be requested via email or letter. (A sample letter is provided below, and we suggest you include a self-addressed stamped envelope.)
b) Permission may be requested through the Copyright Compliance Center pay-per-use permission
service. This service may be requested through the Copyright Compliance Librarian. However the fee is paid by the Faculty member or the department with which they are affiliated.
5) If copyright permission is denied by the owner, the item will not be placed on Reserve.
6) If a response is not received from the copyright holder within two weeks of the request for copyright permission, material may be placed on reserve for the current academic semester if the Faculty member provides a dated copy of the copyright request letter to the Copyright Compliance Librarian.
7) Torreyson Library Staff will not place any material on reserve until it has been approved for copyright compliance by the Copyright Compliance Librarian.
8) Please allow ten business days for processing of your Reserve placement requests.
